Privacy Policy

This Privacy Policy is a document linked to the terms and conditions of the website monum-lawyer.pl, available at this address https://monum-lawyer.pl/regulamin/ („Terms and Conditions”). The definitions of terms used in the Terms and Conditions shall apply mutatis mutandis to the Privacy Policy.

The policy is for informational purposes and fulfils the information obligations imposed on MONUM LAWYER as a data controller by the GDPR, i.e. Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The policy describes the rules for processing personal data, both in relation to processes carried out via the website monum-lawyer.pl and outside of it, within the scope of providing legal services and undertaking other activities by the entity indicated in point 1.1 of this Policy.

 

  1. DATA CONTROLLER

1.1. The administrator of the personal data of the Users of the Service, including recipients of Alerts, visitors to the Service, users of legal services, and those who contact MONUM LAWYER (hereinafter collectively referred to as „Users”), is Emilia Łobińska-Szyc, conducting business activities under the name „MONUM Lawyer’s Office Kancelaria Radcy Prawnego Emilia Łobińska-Szyc” with its registered office at ul. Świętojańska 105/2, 81-381 Gdynia, NIP: 5372386613, REGON: 221982087.

  1. DATA PROCESSING METHOD

2.1. The scope, objectives, and legal bases for the processing of personal data by MONUM LAWYER are presented as follows:

2.2. Purpose of processing: PROVIDING ACCESS TO THE SERVICE

2.2.1. Data range IP address;

2.2.2. Legal basis for processing: art. 6(1)(b) GDPR – processing is necessary for the performance of a contract or to take steps at the request of the data subject prior to entering into a contract;

2.2.3. Data processing period: until the expiry of the limitation period for claims related to access to the Service and the User's actions within the Service, calculated from the moment of the User's last visit to the Service or from the occurrence of an event causing liability of MONUM LAWYER or the User. In the absence of a justified suspicion of the need to process data for the purpose of protecting against claims or asserting claims, data will be deleted no later than 6 months from the moment of their acquisition.

2.3. Processing purpose: PROVISION OF LEGAL SERVICES IN ACCORDANCE WITH THE CONCLUDED AGREEMENT

2.3.1. Data range First name, surname, phone number, email address, details of the business carried out, details of the employer/client/principal, position, any other personal data provided by the client to MONUM LAWYER in connection with legal assistance provided by MONUM LAWYER;

2.3.2. Legal basis for processing: Art. 6(1)(b) GDPR – processing is necessary for the performance of a contract or to take steps at the request of the data subject prior to entering into a contract, Art. 6(1)(f) GDPR – the legitimate interest of MONUM LAWYER as the controller, consisting of the performance of a contract concluded with the employer/principal/client.

2.3.3. Data processing period: until the statute of limitations for claims related to the provision of legal services by MONUM LAWYER expires; In the absence of a justified suspicion that personal data needs to be processed for protection against claims or for pursuing claims, the data will be deleted within 6 months from the final termination of cooperation, unless further processing of data is necessary due to our legal obligations (Article 6(1)(c) GDPR) or is necessary to protect your vital interests (Article 6(1)(d) GDPR, this may relate to legal advice or other actions that MONUM LAWYER has taken on your behalf).

2.4. Purpose of processing: ORGANISING MEETINGS (INCLUDING ONLINE AND TELEPHONE MEETINGS), RECORDING THEIR PROCEEDINGS

2.4.1. Data range Name, surname, email address, voice (within the recording of the data subject’s statement), other personal data disclosed by the data subject during the meeting.

2.4.2. Legal basis for processing: art. 6(1)(f) GDPR – the legitimate interest of MONUM LAWYER as the controller, consisting of: (i) organising meetings with clients or potential clients; (ii) documenting and recording the course of meetings in order to confirm the arrangements made by the participants and improve the process of providing legal services.

2.4.3. Data processing period: until MONUM LAWYER has completed the ordered services (data will be deleted no later than 6 months after the completion of the project to which the recording relates) or until the data subject objects; in the event that, in connection with the cooperation, there was a factual necessity to pursue claims or defend against claims for a longer period, i.e. until the expiry of the statute of limitations for these claims or the final conclusion of proceedings related to these claims.

 

2.5. Processing purpose: IMPLEMENTATION OF PARTNERSHIP COOPERATION

2.5.1. Data range Name, surname, email address, phone number, details of the business activity, details of the employer/client/principal, position;

2.5.2. Legal basis for processing: art. 6(1)(b) GDPR – processing is necessary for the performance of a contract or to take steps at the request of the data subject prior to entering into a contract;

2.5.3. Data processing period: until the expiry of the statute of limitations for claims related to the performance of cooperation by MONUM LAWYER. In the absence of reasonable suspicion of the need to process data for the purpose of protection against claims or asserting claims, data will be deleted no later than 6 months after the final termination of cooperation.

2.6. Purpose of processing: Sending alerts and other materials such as newsletters

2.6.1. Data range email address;

2.6.2. Legal basis for processing: art. 6(1)(a) GDPR – consent of the data subject given within the Service or otherwise; art. 6(1)(f) GDPR – the legitimate interest of MONUM LAWYER as controller consisting in sending materials concerning law and changes in law to former and current clients of MONUM LAWYER;

2.6.3. Data processing period: until the withdrawal of previously given consent (if the processing of personal data is based on Article 6(1)(a) of the GDPR); until the data is no longer useful for sending Alerts; until the data subject objects (if the processing of personal data is based on Article 6(1)(f) of the GDPR);

2.7. Purpose of processing: HANDLING ENQUIRIES SUBMITTED WITHIN THE SERVICE FUNCTIONALITY

2.7.1. Data range name, surname, email address, other personal data voluntarily provided by the User in the contact form;

2.7.2. Legal basis for processing: art. 6(1)(f) GDPR – MONUM LAWYER's legitimate interest as the controller, consisting of handling messages and queries from Users who have used the contact form functionality;

2.7.3. Data processing period: until the data is no longer fit for purpose, understood as: i) 1 year from the date correspondence ends; ii) the decision not to use MONUM LAWYER's legal services.

2.8. Purpose of processing: Issue of invoices and other accounting documents

2.8.1. Data range First name, last name, VAT ID, state registration number, business operating address, company, employer/client details, email address.;

2.8.2. Legal basis for processing: art. 6(1)(c) GDPR – processing is necessary for compliance with a legal obligation to which MONUM LAWYER is subject;

2.8.3. Data processing period: for the period of keeping accounting documents resulting from legal provisions (as a rule, 5 years from the end of the year in which the accounting document was issued).

 

2.9. Purpose of processing: TRAFFIC ANALYSIS AND OTHER STATISTICAL ACTIVITIES WITHIN THE SERVICE

2.9.1. Data range IP address; cookies necessary for collecting statistical information;

2.9.2. Legal basis for processing: Art. 6(1)(a) GDPR – User consent;

2.9.3. Data processing period: until the data is no longer useful or consent is withdrawn by the User.

2.10. Purpose of processing: PROTECTION FROM CLAIMS, CLAIMS MANAGEMENT

2.10.1. Data range E-mail address, first name, surname, other data voluntarily provided by the data subject during cooperation with MONUM LAWYER.

2.10.2. Legal basis for processing: Art. 6(1)(f) GDPR – the legitimate interest of the controller consisting in protection against claims and pursuing claims, where there is a reasonable suspicion of the need to process personal data for this purpose.

2.10.3. Data processing period: until the expiry of the statute of limitations for claims related to access to the Service and the User's activities within the Service, calculated from the moment of the User's last visit to the Service or the occurrence of an event that gives rise to MONUM LAWYER's or the User's liability.

2.11. Providing personal data within the Services is voluntary, however, failure to do so may prevent the provision of services or responding to an inquiry.

2.12. MONUM LAWYER does not transfer personal data to third countries (outside the European Economic Area).

2.13. MONUM LAWYER will not undertake profiling, including automated decision-making, based on the User's personal data.

2.14. In some cases, MONUM LAWYER may obtain personal data from the employer/client/principal of the data subject. In such cases, the source of the personal data is the entity with whom the data subject collaborates. The purposes for which such personal data may be processed by MONUM LAWYER have been indicated above.

  1. Data recipients

3.1. MONUM LAWYER may entrust the processing of personal data to third parties for the purpose of performing the activities indicated in the Regulations and User service. In such cases, the recipients of the User's data may include: the hosting provider for the Service, the e-mail service operator, a company providing technical support for the performance of the Services (software development company), a service provider for sending e-mail messages, consultants and lawyers collaborating with MONUM LAWYER, and entities providing website traffic analysis solutions.

3.2. Personal data collected by MONUM LAWYER may also be disclosed: to relevant state authorities at their request, based on applicable legal provisions, or to other persons and entities – in cases provided for by law.

3.3. Any entity to whom MONUM LAWYER entrusts the processing of User personal data, on the basis of a data processing agreement, guarantees an adequate level of security and confidentiality for the processing of personal data. The processor may further entrust the processing of User personal data only on the basis of prior consent from MONUM LAWYER.

3.4. Disclosure of personal data to unauthorised entities, in accordance with the Privacy Policy, may only take place with the prior consent of the User to whom the data relates.

  1. RIGHTS OF DATA SUBJECTS

4.1. Each User has the right to: (a) delete personal data collected about them from both the MONUM LAWYER system and the databases of entities with which MONUM LAWYER cooperates or has cooperated, (b) restrict the processing of data, (c) transfer personal data collected by MONUM LAWYER about the User, including receiving it in a structured format, (d) request access to and rectification of their personal data from MONUM LAWYER, (e) object to processing, (f) withdraw consent from MONUM LAWYER at any time without affecting the lawfulness of processing based on consent before its withdrawal; (g) lodge a complaint against MONUM LAWYER with the supervisory authority (President of the Personal Data Protection Office).

4.2. The exercise of the rights described above may be carried out by contacting us using the addresses mentioned in section 1.2 of the Privacy Policy.

5.1. MONUM LAWYER may store HTTP requests, and as a result, certain information may be saved in server log files, including the IP address of the computer from which the request came, the User's station name – identification carried out by the HTTP protocol, if possible, the date and system time within the Service and the time of the request, the number of bytes sent by the server, the URL of the page previously visited by the User, if they arrived via a link, information about the User's browser, and information about errors that occurred during the HTTP transaction. Logs may be collected as material for the proper administration of the Service. Access to this information is restricted to individuals authorised to administer the IT system. Log files may be analysed to compile statistics on traffic within the Service and any errors that occur. A summary of such information does not identify the User.

MONUM LAWYER applies technical and organisational measures to ensure the protection of personal data processed, appropriate to the threats and categories of data protected, and in particular, it technically and organisationally secures data against disclosure to unauthorised persons, removal by an unauthorised person, processing in violation of the Act, and alteration, loss, damage or destruction, including through the use of SSL certificates. The collection of Users' personal data is stored on a secured server, and the data are also protected by MONUM LAWYER's internal procedures regarding personal data processing and information security policy.

6.2. MONUM LAWYER has also implemented appropriate technical and organisational measures, such as pseudonymisation, designed to effectively implement data protection principles, such as data minimisation, and to incorporate safeguards into the processing necessary to meet the requirements of the GDPR and to protect the rights of data subjects.

6.3. MONUM LAWYER points out that using the internet and electronic services may be associated with the risk of malicious software (malware) entering the User's teleinformatic system and device, as well as unauthorised access to the User's data, including personal data, by third parties. To minimise these risks, the User should implement appropriate technical safeguards, e.g. by using up-to-date anti-virus programs or programs protecting the User's identity on the internet. To obtain detailed and professional information regarding internet security, MONUM LAWYER recommends seeking it from entities specialising in such IT services.

7.1. For proper functioning, the MONUM LAWYER Service uses cookie technology. Cookies are packets of information saved on the User's device via the Service, usually containing information consistent with the purpose of the given file, used by the User to access the Service – these typically include: service address, placement date, expiry date, unique number, and additional information consistent with the purpose of the given file.

7.2. MONUM LAWYER uses two types of cookies: (a) session cookies, which are permanently deleted when the User's browser session ends; (b) persistent cookies, which remain on the User's device after the browser session ends, until they are deleted.

7.3. Based on session and persistent cookies, it is not possible to determine the identity of the User. The cookie mechanism does not allow for the retrieval of any personal data.

7.4. Cookies used by MONUM LAWYER are safe for the User's device. In particular, they do not allow viruses or other software to enter the device.

7.5. Files generated directly by MONUM LAWYER cannot be read by other services. External cookies (i.e. cookies placed by entities cooperating with MONUM LAWYER) may be read by an external server.

7.6. The User can independently change the settings concerning Cookies at any time, by specifying the conditions for their storage, through the settings of their web browser or by configuring the service, as well as by using the website's functionality.

7.7. First and foremost, the User can disable the saving of Cookies on their device, in accordance with the browser manufacturer's instructions, but this may result in the unavailability of some or all of the functions offered within the Service.

7.8. The user may also delete Cookies saved on their device at any time, in accordance with the browser manufacturer's instructions.

7.9. MONUM LAWYER uses its own Cookies for the following purposes: user authentication, maintaining user sessions; configuration; analysis and study of audience engagement, click counts and navigation paths within the Website in order to improve the appearance and organisation of content within the Website, time spent on the page, and the number and frequency of visits to the Website.

7.10. MONUM LAWYER uses External Cookies for the following purposes: to create (anonymous) statistics that allow for the optimisation of usability.

7.11. The scope of Cookies used by MONUM LAWYER depends on the consent given by the User within the Service.
